Terms of Service

1. Acceptance of Terms

By registering for, accessing, or using Domainwarden, you confirm that you accept these Terms and agree to comply with them. If you do not agree to these Terms, you must not use our Service.

2. Description of Service

Domainwarden is a domain monitoring application that tracks and alerts users about changes to domain WHOIS records and DNS data. The Service is provided on a subscription basis.

3. Account Registration

To use Domainwarden, you must:
  • Provide accurate and complete registration information, including your name and email address
  • Maintain the security of your account credentials
  • Be at least 18 years of age or have parental/guardian consent
  • Notify us immediately of any unauthorized use of your account
You are responsible for all activities that occur under your account.

4. Subscription and Payment

4.1 Subscription Plans

Access to Domainwarden requires an active paid subscription. Subscription details, including pricing and features, are available on our website.

4.2 Payment Processing

All payments are processed through our third-party payment provider, Mollie. By subscribing to our Service, you agree to provide valid payment information to Mollie and authorize them to charge your chosen payment method.

4.3 Billing

Subscriptions are billed on a recurring basis according to your selected plan (monthly or annual). You will be charged automatically at the beginning of each billing cycle unless you cancel your subscription.

4.4 Refunds

If Domainwarden is not right for you, we understand. Get in touch with support within 14 days of your purchase so we can offer you a refund—no questions asked.

5. Acceptable Use

You agree to use Domainwarden only for lawful purposes and in accordance with these Terms. You must not:
  • Use the Service in any way that violates applicable laws or regulations
  • Attempt to gain unauthorized access to our systems or networks
  • Use automated systems (bots, scrapers) to access the Service without our express written permission
  • Reverse engineer, decompile, or disassemble any portion of the Service
  • Use the Service to monitor domains without proper authorization
  • Resell, redistribute, or provide access to the Service to third parties without our permission
  • Engage in any activity that interferes with or disrupts the Service

6. Service Availability

While we strive to provide reliable service, we do not guarantee that Domainwarden will be available at all times without interruption. We may:
  • Suspend or restrict access to the Service for maintenance or updates
  • Modify or discontinue features with reasonable notice
  • Experience downtime due to circumstances beyond our control
We are not liable for any losses resulting from Service unavailability.

7. Data and Monitoring

7.1 Domain Data

The Service collects and stores domain WHOIS and DNS data for domains you choose to monitor. This data is collected from publicly available sources.

7.2 Data Accuracy

While we make reasonable efforts to provide accurate monitoring data, we do not guarantee the accuracy, completeness, or timeliness of domain information. You should verify critical information independently.

7.3 Your Responsibilities

You are responsible for ensuring you have the right to monitor any domains you add to the Service. You must not use the Service to monitor domains in violation of applicable laws or third-party rights.

8. Intellectual Property

8.1 Our Rights

All intellectual property rights in Domainwarden, including software, design, trademarks, and content, belong to us or our licensors. These Terms do not grant you any ownership rights to the Service.

8.2 Limited License

We grant you a limited, non-exclusive, non-transferable license to access and use the Service for your personal or internal business purposes, subject to these Terms.

9. Account Termination

9.1 Your Rights

You may cancel your subscription and delete your account at any time through the Service interface. Upon account deletion:
  • Your access to the Service will be terminated
  • Your account data will be deleted in accordance with our data retention policies
  • No refunds will be provided for unused subscription time unless you are within the 14-day refund period

9.2 Our Rights

We reserve the right to suspend or terminate your account if:
  • You breach these Terms
  • Your payment fails or your account becomes delinquent
  • We are required to do so by law
  • We reasonably believe your use of the Service poses a security or legal risk
We will provide reasonable notice before termination unless immediate suspension is necessary.

10. Limitation of Liability

To the maximum extent permitted by law:
  • Domainwarden is provided “as is” without warranties of any kind, express or implied
  • We are not liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Service
  • Our total liability to you for all claims relating to the Service shall not exceed the amount you paid us in the 12 months preceding the claim
  • We are not responsible for any losses resulting from inaccurate monitoring data, missed alerts, or Service downtime
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under applicable law.

11. Third-Party Services

Our Service integrates with third-party services (including Mollie for payments). We are not responsible for the availability, accuracy, or practices of these third-party services. Your use of third-party services may be subject to their own terms and conditions.

12. Changes to Terms

We may modify these Terms from time to time. If we make material changes, we will notify you by email or through the Service at least 30 days before the changes take effect. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

13. Governing Law and Jurisdiction

These Terms are governed by the laws of England and Wales. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.

14. General Provisions

14.1 Entire Agreement

These Terms constitute the entire agreement between you and Domainwarden regarding the Service and supersede all prior agreements.

14.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full effect.

14.3 Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

14.4 Assignment

You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms without restriction.
